I am happy to be a director with Fennemore Wendel, and have over 30 years experience assisting business clients with creative solutions in challenging circumstances in all aspects of insolvency: chapter 11 reorganization and liquidations, chapter 7 liquidations, assignments for the benefit of creditors, and workouts. DEBTORS: I work with troubled businesses to examine the best method of restructuring or liquidating in or out of bankruptcy when they are faced with heavy debt burdens as a result of changing market conditions, expensive litigation or judgments, defaulted loans, creditor or partnership disputes. BUYERS: Assist buyers in purchasing assets out of bankruptcy cases to ensure that they obtain orders with sufficient protection from successor liability, and overbidding. VENTURE CAPITALISTS: Assist equity holders to restructure debt through a chapter 11 bankruptcy case to make company attractive to new investors. CREDITORS' COMMITTEE: Representative creditor committees in bankruptcy cases and out of court workouts to obtain the best return under the circumstances of that case. SECURED CREDITORS: Secured creditors seek my assistance in enforcing promissory notes, representing their interests in on going proceedings in a bankruptcy case, and protecting their interest in collateral: motions for relief from stay; use of cash collateral; negotiate or object to plan terms LANDLORDS: Ensure that the landlords rights are protected in the bankruptcy case, and the landlords proceed to enforce their rights against the debtor. HOMEOWNER ASSOCIATIONS: Represent homeowner associations in bankruptcy cases. JUDGMENT HOLDERS AND OTHER UNSECURED CREDITORS: Bankruptcy is frequently filed in the course of litigation. I work with the client to determine whether the litigation should go forward in state court, or it should be moved to the bankruptcy court, and what is the best way to maximize recovery. MEDIATOR: I have worked with a variety of parties as a mediator, and have high success rate where the parties reached an agreement so that they could move forward and stop spending money on legal fees. My expertise is in commercial disputes in and out of bankruptcy court.
