About Stephen Kennedy

With over 37 years of experience, I am a seasoned attorney specializing in complex litigation and intellectual property matters. I have successfully represented clients in cybersecurity litigation, video surveillance technology disputes, software copyright infringement, high-tech patent infringement, copyright misuse, patent-antitrust, IP transactions, International Trade Commission proceedings, FINRA arbitration, and employment litigation. My litigation practice focuses on technology cases involving cybersecurity, surveillance technology, medical devices, lasers, semiconductors, photography equipment, and chemical compounds, as well as copyright and trademark infringement, patent-antitrust actions, Lanham Act claims, right of publicity disputes, and complex commercial litigation, including publication licensing agreements. I have advised international, national, and regional corporations, developing and executing effective litigation strategies and IP transactions. Recent Achievements In September 2024, I secured a $2 million jury verdict under the Texas Whistleblower Act for an IT employee terminated after reporting government corruption involving falsified CJIS access at the City of Fort Worth. I also represented the former Fort Worth Police Chief and another IT services employee, leading to a $9.6 million settlement for all three cases. In 2018, I won a $5.6 million jury verdict (plus fees and costs) for breach of an investment banking agreement and a $4.7 million verdict (plus fees and costs) in a copyright case. In December 2006, I obtained a $27 million sanctions order against a party violating a preliminary injunction in a software copyright case. Recently, I secured three preliminary injunctions across multiple jurisdictions in copyright and trade secret cases, each with impoundment orders covering over 100 pieces of computer equipment. In February 2003, I prevailed in an appeal at the Federal Circuit, resolving a patent claims construction issue. Notable Case In 1998-1999, I was part of a team representing recording artist Don Henley in a right of publicity suit against Dillard’s Department Store. My key deposition of a Dillard’s representative led to summary judgment on liability, with the deposition extensively cited in the court’s opinion.
