We have all heard those horror stories where friends or family members go into business together and the relationship falls apart. Or the heartbreaking situation where grandparents have been taken advantage of late in life whether it is from the wrongful taking of assets or the suspicious alteration of long standing estate plans. That’s where I come in. I am a seasoned litigator who focuses on equity disputes, fiduciary litigation, and will/trust contests regardless of whether such claims arise in the boardroom or the dining room. In the business realm, I have litigated cases involving corporate governance, fraud, breach of fiduciary duty, and equity disputes between shareholders, member, or partners. Recently, I successfully dismissed a case against my client where the buyer alleged fraud and breach of contract in connection with a real estate purchase. In addition, I have litigated highly contentious trust and estate matters. I have represented fiduciaries in multifaceted accounting and surcharge matters, and have represented beneficiaries in prosecuting claims for breach of fiduciary duty. I have also successfully litigated numerous disputes over testamentary instruments and elder abuse, including claims against unscrupulous caregivers or long lost relatives who suddenly re-emerge when a person is near the end of her life. In one of the most high-profile probate matters in recent memory, I successfully represented the children of legendary radio host Casey Kasem in obtaining a conservatorship over Mr. Kasem’s person along with a recovery of my clients’ attorneys’ fees. My team and I have a proven track-record, successfully taking many cases to trial and through the appellate process. However, not all cases need to go to trial. In general, most cases are resolved before that point. Nonetheless, showing your opponent that you are serious by retaining an attorney with trial credentials will maximize your negotiating leverage if the opportunity for resolution presents itself.
