About Robert Whitaker
My practice is focused on representing employers in all aspects of state and federal employment law and commercial litigation. I serve as lead counsel in federal, state and local courts and before federal and state agencies like the department labor, NYS Division of Human Rights, NYS Industrial Board of Appeals and NYS Unemployment Insurance Appeal Board. I have litigated numerous cases to verdict and argued appeals before the NYS Appellate Division and Second Circuit Court of Appeals. My litigation experience includes claims related to unlawful discrimination, sexual harassment, unpaid wages including wage and hour class-action defense, retaliation, restrictive covenant enforcement, unfair competition, breach of fiduciary duty and duty of loyalty, breach of contract and other commercial disputes. I am also experienced in prisoner civil rights litigation having served as pro bono trial counsel for plaintiff prisoners and as defense counsel for correctional facilities and their employees. Additionally, I am experienced with enforcing copyrights in federal court on behalf of national and international musical composers, authors and lyricists. Before entering private practice, I served as a defense attorney for the Navy Judge Advocate General’s Corps (Navy JAG Corps), representing active duty military personnel in military federal courts throughout the southeastern United States. As a JAG, I also served as Deputy Staff Judge Advocate (e.g., Deputy General Counsel) and prosecutor for the Commanding General of the 2nd Marine Logistics Group in Al Anbar, Iraq. I continue to serve in the Navy Reserve (NR) where I hold the rank of Commander. While in the NR, I have served as a legal assistance attorney, Department Head of Litigation for NR Civil Litigation, and Executive Officer of NR Administrative Law and Civil Law commands in Washington, DC.
