Nedim Novakovic

I am a senior employment counsel, licensed in California, with eight years of experience working cross-functionally with technology and life sciences companies of all sizes to achieve their employment law goals. My practice focuses on five areas. First, I advise employers on employment and labor matters per federal, state, and local laws. This includes recruitment, hiring, diversity and inclusion, performance management, terminations, reductions in force, mass layoffs, employee mobility, internal and external investigations, leaves of absence, reasonable accommodations, employment policy, and wage-and-hour compliance, such as contractor and employee classifications, wage payments, audits, and remediation. Second, I draft, review, revise, and implement employment policies and practices, working with different internal teams, such as HR, executives, and directors. Third, I defend employers in single-plaintiff, class, collective, and representative employment law cases, in court, arbitration, and state/federal agencies. My litigation experience began as I clerked for the Honorable Stephanie M. Rose in the Southern District of Iowa and externed for the Honorable William H. Orrick III in the Northern District of California. I then spent eight years defending employers, including dismissing lawsuits early at the demurrer/motion to dismiss stage for failure to state a claim, lack of jurisdiction, inconvenient forum, and applicability of arbitration agreements. Fourth, I negotiate, review, and draft employment, independent contractor, confidentiality, separation, and similar agreements, from low level employees to executives. This includes expertise in mobility issues, such as employees moving from one jurisdiction to another as well as non-competes and non-solicits. Finally, I conduct due diligence and negotiate transaction agreements from an employment law perspective in public and private corporate transactions, such as asset purchases and M&As.
