Mark Tabakman

I am an all-around Labor & Employment Partner, representing union and non-union clients in a wide array of matters, ranging from union negotiations and labor arbitrations, to employment litigation and providing daily (if not hourly) advice-and-guidance to clients on flashpoint issues such as hiring and firing, disability and accommodation matters and development of personnel policies and Employee Handbooks. My North Star of counselling is to stress a proactive approach, one that stops problems from arising, as opposed to putting out fires du jour. I have a deep experience in defending wage-hour/overtime cases; I have defended more than 300 employers in wage-hour audits of all kinds (e.g. overtime, working time, independent contractor, prevailing wage and Davis Bacon Act/Service Contract Act) and numerous wage-hour litigations and class actions. My goal is to always find the best/most cost effective way to solve a client’s problem, guide that client to future compliance so the problem(s) never happen again.I publish a blog entitled Wage and Hour-Developments and Highlights, in which I write about recent cases and developments, outlining the problems that these cases/situations present for employers and how they may fix them and/or be proactive about avoiding them, the ideal solution. My pro bono work is focused on advancing the interests of aging Americans to facilitate their living independently and staying in their communities for as long as possible. I serve on the Board of Trustees (for almost twenty years) of the New Jersey Advocates for Aging Well and served as Chair of the Board for six years. It is immensely gratifying work.
