Mark Preiss

I am a partner in GRSM’s Labor and Employment, Trucking, and Government Investigations & Enforcement Defense practice groups. I have extensive experience representing corporate clients in state and federal courts, as well as agencies such as OSHA, HUD, DOT, EEOC, and state fair employment practice agencies. Such representations include mediation, arbitration, and other forms of alternate dispute resolution. In the labor and employment context, my representation includes a hybrid of counseling and litigation. This includes employer-side representation before state and federal courts, as well as administrative agencies, in defending against claims involving discrimination, hostile work environment, retaliation, wrongful termination, and sexual harassment. My practice has also included labor grievance hearings and negotiating claims involving non-compliance with collective bargaining agreements and project labor agreements. I also counsel businesses on effective employment law risk management strategies and provides guidance on application of company policies and compliance with federal and state employment statutes, including the federal Family and Medical Leave Act, the Fair Labor Standards Act, and the Americans with Disabilities Act, among others. I regularly counsel employers on hiring practices, terminations, workplace investigations, reductions in work force issues, and litigation avoidance practices. I have conducted dozens of in-person trainings and webinars on employment law topics for businesses, including but not limited to identifying and preventing harassment and discrimination in the workplace, pay equity and gender discrimination, and medical leaves of absence. I also prepare contracts, vendor agreements, employment agreements, employee handbooks, and have negotiated the resolution of claimed breaches of non-compete/non-disclosure agreements. My civil litigation practice also includes complex litigation defense in state and federal courts for claims covering contract, tort, housing, commercial real estate, professional liability, trucking, and insurance issues, including outlining litigation plans targeted at efficient, cost-effective resolution of claims. I am admitted to practice law in the Commonwealth of Massachusetts, State of New York, the U. S. Dist. Court, Dist. of Mass., and the State of Maine.
