Mark Kotwick

Mark D. Kotwick is a partner in Seward & Kissel's Litigation Group. Mark has practiced law since 1989 and became a partner in the Firm in 2000. Mr. Kotwick represents clients in a wide variety of complex and sensitive matters, including those involving securities litigation, banking and commercial controversies, employment law, and partnership and real estate disputes. He also regularly advises clients on employment matters, including employment contracts, restrictive covenants, reductions in force, group hirings and other work place issues. Representative litigation matters include: • Representing financial institution in a putative federal securities class action in the nationwide Enron litigation • Representing lender in a series of related actions between lenders and limited partners arising from the unwinding of an Enron-related limited partnership • Representing bank in a dispute involving a $500 million credit default swap agreement in proceedings in New York and London • Representing private standard setting association in a putative class action alleging that its activities violated federal antitrust laws • Representing investment limited partnership and investment advisor in a derivative action regarding a dispute involving alleged short swing profits under federal securities laws • Representing housing company in a class action attempting to prevent its withdrawing two rental apartment buildings (representing more than 1,200 units) from New York’s Mitchell Lama housing program and $500 million condominium conversion plan • Representing financial institution in a litigation arising from a group hiring and the transfer of the management of a CDO fund with assets in excess of one billion dollars Specialties: Mr. Kotwick represents clients in matters including securities litigation, banking and commercial controversies, employment law, and partnership and real estate disputes.
