Mark Fisher

I have been called a “lawyer’s lawyer,” because I have drafted portions of the laws governing secured transactions, equipment leasing and bankruptcy that are central to my court advocacy, negotiations and drafting. Striving to present the law and underlying reasons in practical terms has helped me resolve hundreds of deals and cases in my 44 years as a finance and restructuring lawyer with the firm. I practice in the “intensive care” wing of the legal system. My experience helps me to quickly size up the documents, players and perspectives of a transaction, because timely advice is essential in bankruptcy and creditors’ rights matters. Those insights are just as important in structuring a highly leveraged transaction or distressed acquisition as they are in enforcing a lender’s rights or defending against a lender liability or fraudulent transfer attack. Spotting areas of common interest has allowed me to organize cooperative groups in workouts and bankruptcies that save money, apply pressure and lead to quicker, less expensive and more favorable resolutions. Bankruptcies turning on the treatment of futures and forward contracts, healthcare, mass torts, insurance and intellectual property are a focus of my practice.
