Marcia McShane

Marcia draws on more than 25 years of experience advising and defending employers in all aspects of workplace law. She represents management in high-stakes matters involving employee defection; misappropriation of trade secrets; wage and hour compliance; and claims of workplace harassment, discrimination, and failure to accommodate. Marcia works with clients to identify and mitigate legal risks that align and advance their broader business objectives. Known for her strategic approach to complex employment disputes, Marcia has defended employers in administrative proceedings and at the trial and appellate levels in state and federal court across the Southeast. Marcia works proactively with her clients to prevent litigation through updated policy creation, as well as compliance training, while maintaining the readiness to aggressively defend matters when disputes arise. Marcia also has experience as a Rule 31 Neutral, serving as mediator or arbitrator for workplace-related disputes. Before joining Fisher Phillips, Marcia held senior public sector leadership roles with Tennessee state agencies serving vulnerable populations. As Chief of Staff for the Tennessee Commission on Aging & Disability (TCAD), she oversaw the agency’s legal team, managed regulatory compliance, and advised on operations supported by an $81 million annual budget. Earlier, as Assistant Commissioner for the Tennessee Department of Human Services (DHS), Marcia directed the department’s Public Information and Legislative Office, testified before the Tennessee General Assembly, managed all external and internal communications for the department, and served on the Executive Leadership Team. Marcia previously spent 12 years as a partner in the Nashville office of a national law firm, representing employers ranging from small businesses and healthcare providers to large manufacturers and Fortune 500 companies across the full spectrum of employment law compliance and litigation. Marcia is admitted to practice law in all state and federal courts in Tennessee and Mississippi, the U.S. District Court for the Northern District of Florida, the U.S. Court of Appeals for the Fifth and Sixth Circuits, and the U.S. Supreme Court.
