First-hand experience and in-depth understanding of the special demands of employment and education law as they apply to educational institutions. Successfully represent private and public colleges and universities, independent schools and non-profit organizations in litigation of employment and student legal disputes before state and federal courts and administrative agencies, including with respect to mediations, arbitrations, jury trials, bench trials and write of mandamus actions. Provide advice and counsel to officers of educational institutions on business and risk management practices and policies in the areas of preventing harassment, discrimination and retaliation claims, student discipline and expulsion, faculty and staff discipline and termination, equal employment opportunity law compliance, ADA and Section 504 reasonable accommodations and contracts. Also advise educational institutions regarding accreditation, governance and high profile crisis management situations, including how to effectively message with different university constituencies about sensitive matters in light of privacy considerations. Have served as general counsel for colleges without in-house legal departments. Update faculty, staff and student policy manuals to comply with the law and best practices. Regularly conduct training classes for faculty, staff, administrators and/or trustees on prevention of sexual harassment, discrimination and retaliation, student and employee disability accommodations, employee performance management, student and employee privacy, student and employee discipline, special issues with respect to religious educational institutions and board governance.
