Kelly Day

I am an appellate attorney and employment litigator with more than twenty years of experience representing employers, governmental entities, insurers, executives, and businesses in high-stakes employment, commercial, and appellate litigation.My practice focuses on helping clients position cases for success at every stage of litigation—from early motion practice through trial, post-trial proceedings, and appeal. I regularly advise trial teams on dispositive motions, preservation of error, jury charge issues, extraordinary writs, appellate strategy, and complex legal issues that can determine the outcome of a case.Before entering private practice, I served as a judicial law clerk to the Ohio Second District Court of Appeals and two United States District Courts. Those clerkships continue to shape my approach to advocacy by providing insight into how appellate and trial judges analyze difficult legal questions.Throughout my career, I have represented clients before state and federal appellate courts, including matters before the United States Supreme Court, the Ninth Circuit, and the California Supreme Court. My experience spans employment litigation, commercial litigation, constitutional issues, class actions, wage-and-hour disputes, and high-exposure appeals.I enjoy partnering with trial lawyers early in litigation to preserve appellate issues, strengthen dispositive motions, develop winning legal strategy, and help clients achieve successful outcomes.
