Joseph Mulherin

As an Employment Partner at McDermott Will & Emery, I provide my clients with practical, innovative and cost-effective representation on an array of complex employment law litigation and counseling matters. I have extensive experience defending employers nationwide in a variety of industries against class action and single plaintiff lawsuits, including wage-and-hour and employment discrimination actions. I also have significant experience representing employers in federal and state governmental agency investigations, including audits conducted by the United States Department of Labor and the Equal Employment Opportunity Commission and their state counterpart agencies. Counseling clients on best employment policies and practices is also a significant part of my practice. I regularly advise clients on discipline and termination decisions, leave laws and disability accommodation, web accessibility for disabled individuals, independent-contractor classification and wage payment laws, including vacation, commission and bonus plans. I also frequently advise clients on wage-and-hour policies and practices relating to timekeeping, rounding, meal and rest periods, travel time, donning and doffing, on-call time and handheld devices. I regularly write and lecture on these and other employment law topics. I represent and advise my clients in a holistic manner that fully considers and weighs the requirements of the law, the client’s business needs and the potential litigation exposure.
