Jon Miller

I represent and counsel employers of all sizes in a range of employment and labor matters. My practice often involves defending employers against lawsuits filed by former or current employees. I have experience in all facets of the litigation process, from initial investigation and filing, through trial and appeal. I also represent employers before federal and state administrative agencies, including the California Department of Fair Employment and Housing, U.S. Equal Employment Opportunity Commission, California Division of Labor Standards Enforcement, U.S. Department of Labor, and National Labor Relations Board, among others. In addition to defending employers against lawsuits, I also work closely with human resources departments, in house counsel, and key managers and business owners in helping to prevent employment litigation. I provides effective day-to-day advice and strategic counsel on a variety of workplace issues, such as hiring and firing, discipline of personnel, sexual harassment claims and investigations and other workplace investigations, the interplay between family and medical leave and the interactive process, unlawful discrimination, reduction in force planning, and employment and confidentiality agreements, among others. I facilitate audits of employment policies and practices to ensure compliance with state and federal employment laws. I prepare and review employee handbooks, personnel policies, and employment contracts. I conduct employment and labor-related presentations to employers in the areas of sexual harassment prevention, discrimination, hiring practices and risk management.
