NOTABLE ACCOMPLISHMENTS • Lead trial counsel for a major Arizona city in complex water rights adjudication trial regarding the Navajo Nation’s water rights from the Little Colorado River watershed for the next 100 years. The first trial for the Navajo Nation’s claims lasted for three and a half months (April 2023 to August 2023). • Co-Lead trial counsel for a major Arizona city in complex water rights adjudication trial regarding the Hopi Tribe’s water rights from the Little Colorado River watershed for the next 100 years. The Hopi Tribe’s trial lasted six months (2020 to 2021) and we prevailed on the issues I tried. • Lead trial counsel for a pharmaceutical manufacturer who was sued by an investor over an obscure FDA generic test issue; prevailed at trial and defeated claims for over $20 million. • Outside General Counsel to a Medicare Advantage Organization for three years. • Counsel to Accountable Care Organization in commercial litigation and regulatory matters. • Counsel to interested parties in several national and international fraud cases. • Bankruptcy counsel to a Fortune 500 debtor and confirmed a liquidating plan of reorganization where the creditors received a full recovery on their claims. • Lead bankruptcy counsel to many senior secured lenders with exposure from $20 million to $500 million. The industries included gas station and convenience store chains, restaurant chains, hotels and resorts, dairy farms, office buildings and strip malls, healthcare, as well as other asset classes. • National counsel to Fortune 10 financial institution in litigation and bankruptcy matters across the United States. • Bankruptcy and litigation counsel to several banks that purchased failed banks through FDIC-assisted transactions that included loss-share agreements. • Co-Lead bankruptcy counsel for a national special servicer owed over $300 million that was secured by two high-end resorts. • Prosecuted and defended over 350 bankruptcy preference actions, with exposure into the hundreds of millions. • Bankruptcy and litigation counsel for most of the leading special servicers and banks in the United States. • Counsel to an international monetary fund on fraud and bankruptcy matters with exposure in excess of $50 million. • Lead counsel to major Wall Street Bank for a defaulted $20 million loan secured by a strip mall.
