Defend employment claims in federal and state courts, particularly NJ and PA, and before federal and state agencies nationwide. Presently busy defending failure to accommodate claims filed under Title VII, the ADA, and their state law equivalents by employees who refused to become vaccinated against COVID-19, in addition to many other accommodation, leave, and discrimination matters. Help employers develop current, compliant, and effective employment policies, with a particular focus on parental leave policies and reasonable accommodation processes. Provide day-to-day counseling to in-house counsel, HR, and business leaders regarding employee complaints, employee discipline, leave and accommodation issues, and performance management. Investigate harassment, discrimination, and retaliation complaints. In addition, I counsel private corporations, foundations, and non-profits regarding DEI programs, grants, and investments that may implicate Section 1981 or other state anti-discrimination laws. I help our clients analyze and sometimes restructure their programs, grants, and investments to mitigate the risk of “reverse discrimination” claims under Title VII, Section 1981, and other anti-discrimination statutes.
