About Derek Havel
I defend employers in complex labor and employment matters, from early case assessment through trial and appeal. My practice centers on wage and hour class actions and California PAGA representative actions, as well as single-plaintiff disputes, and I have taken multiple jury trials to verdict. I regularly help clients defeat class certification and obtain summary judgment in wage and hour cases involving off-the-clock work and rounding, regular-rate and overtime claims, meal and rest period compliance, wage statement issues, and expense reimbursement. I also defend and try discrimination, harassment, retaliation, and wrongful termination matters under California and federal law, including FEHA, Title VII, the ADEA, and the ADA. In addition to litigation, I advise business leaders on practical, risk-focused strategies involving hiring and discipline practices, worker classification, leave management, wage and hour compliance, and severance and termination planning. I also have experience with traditional labor matters, including proceedings before the National Labor Relations Board and defending against unfair labor practice charges.
