David Stein

I help businesses solve their problems so that they can get back to doing what they want to do: running the business. I handle disputes from the early stages, before the filing of a lawsuit, until the completion of trial or hearing, if necessary. I am admitted to practice in the states of Illinois, New York, and Michigan, and numerous federal courts across the country, and often appear before private arbitrators as well as Judges. In my commercial litigation practice, I represent both plaintiffs and defendants in actions asserting breach of contract, breach of warranty, defamation, breach of fiduciary duty (including director and officer liability, and partnership disputes), common law and statutory fraud, tortious interference and other business torts, as well as soft IP disputes including trademark and copyright claims. In addition, I routinely prosecute and oppose motions for emergency relief, including motions for temporary restraining orders and preliminary injunctions. My employment litigation practice focuses on the defense of corporations in actions asserting employment discrimination and retaliation under Title VII, the ADEA, the ADA and other federal and state statutes, and claims alleging violations of overtime laws including the FLSA (including collective actions) and complimentary state statutes. I also routinely prosecute and defend matters involving the enforcement of non-competition and non-solicitation agreements, which often include allegations of the theft of trade secrets under the Defend Trade Secrets Act. Recently, I have also become too familiar with Illinois’ Biometric Information Privacy Act (“BIPA”), due to the rash of class action litigation filed by opportunistic plaintiffs’ firms.
