David Foy

For nearly 30 years, I have successfully defended private, municipal, and nonprofit employers against claims asserting breach of contract, wrongful discharge, discrimination, sexual harassment, wage and hour, and whistleblower violations. I pride myself on my responsivemness to client needs and strive to achieve positive results consistent with my clients’ objectives. I regularly appear before federal and state courts, arbitration tribunals, and government agencies such as the Equal Employment Opportunity Commission, Michigan Department of Civil Rights, U.S. Department of Labor, Michigan Wage and Hour Division, National Labor Relations Board and Michigan Employment Relations Commission. I represent employers in non-competition and non-solicitation disputes as well as misappropriation of trade secrets. I frequently draft employment agreements and handbooks, policies and procedures, and confidentiality agreements, and assist clients in developing systems to protect intellectual property. In the area of traditional labor law, I represent both private and public sector employers in collective bargaining negotiations, arbitrations, grievance resolution, and unfair labor practices claims, matters that have involved the United Automobile Workers, International Brotherhood of Teamsters, and American Federation of State, County and Municipal Employees. I represent companies in mergers and acquisitions. As such, I have assisted a publicly traded global energy company with a $20 million acquisition and also facilitated a $27 million stock sale on behalf of a global automotive market forecasting company. Additionally, I help physicians and dentists form professional limited liability companies and corporations, draft and negotiate buy-sell and employment agreements, and perform due diligence when joining or buying a practice.
