David Fishman

Since 2001, I have represented management and individual entrepreneurs in all aspects of litigation from inception through resolution. I handle all facets of the litigation process in labor and employment disputes. I have defended employers against charges of race, sex, age, national origin, ancestry, and disability discrimination; harassment; retaliation; wrongful discharge in violation of public policy; and defamation. I have specific experience under the California Fair Employment and Housing Act, Title VII, the Age Discrimination in Employment Act, the Americans with Disabilities Act, and other labor and employment laws. I also have experience defending employers in multiple-plaintiff litigation, trade secret/non-compete disputes, and wage and hour class actions including claims for overtime violations, meal and rest period violations, waiting time penalties, and other purported wage and hour violations under federal and California wage and hour laws. In addition, I advise clients regarding various personnel policies and procedures, employee discipline matters, employee handbooks, wage and hour compliance, and other employment issues. I also conduct employee training and investigations at the workplace. I have handled trials in state and federal court, state and federal administrative proceedings, and arbitrations on behalf of my clients. I represent clients from a wide variety of industries, including retail, healthcare, financial services, manufacturing, entertainment, hospitality and gaming.
