Brian Cuttone

Brian is a civil trial lawyer with state and federal court experience primarily in business and real estate litigation. Brian’s experience includes resolving disputes concerning real property transactions and land use, secured transactions, lien enforcement, agribusiness, contract disputes, unfair business practices and bankruptcy matters. Brian has participated in alternative dispute resolution in superior, federal and bankruptcy cases, including mediation, arbitration, neutral case evaluation and work-outs. Brian also serves as a judge pro tem conducting mandatory settlement conferences on behalf of the Fresno County Superior Court, in cases involving real estate disputes. Brian has experience in obtaining and opposing pre-judgment remedies such as temporary and preliminary injunctions, receiverships, and pre-judgment attachment, possession and turnover of property. Brian represents investors, residential and commercial real property owners, sellers and buyers, real estate developers, brokers, agents, building contractors, bankruptcy trustees, creditors and debtors, growers, produce companies, bargaining associations and labor contractors in a wide variety of disputes. Brian has successfully tried cases to verdict in state and federal court, including the United States Bankruptcy Court. Brian has state and federal appellate court experience. Brian earned a Bachelor of Arts degree in Psychology from California State University, Fresno and his Juris Doctor from San Joaquin College of Law. Brian was admitted to the California Bar in 1999. Brian obtained his real estate sales associate license in 1994 and has experience as a real estate broker in charge of risk management, Department of Real Estate compliance, litigation and supervising real estate transactions for over 475 real estate agents and brokers, located in 13 offices in the San Joaquin Valley. Also, Brian teaches continuing education for lawyers in the area of real estate disclosures.
