For organizations around the country, the difference between success and failure can hinge on the protection the integrity of intellectual and human capital. High-stakes cases involving trade secrets and restrictive covenants take many forms but all boil down to the same core business issue: competitive advantage. Across more than 20 years, I have fought to preserve those advantages through both counseling and litigation, for organizations and their directors, officers, executives, and other employees. No two industries and no two organizations are the same, so each engagement requires a customized strategy designed to minimize the risks associated with doing business in extremely competitive conditions. These strategies must reflect the unique circumstances in which organizations do business as the threats facing those operating in advanced technology differ from those in financial services, just as they do in pharma, insurance, healthcare, education, and manufacturing. I approach each engagement from the perspective of the client, to better understand what drives their business and how it can best be protected under the legal circumstances of their home city and state. There is no “one size fits all” approach to trade secret and restrictive covenant law, so my advocacy relies on a nuanced understanding of laws around the country that allows for an assertive posture. In doing so, my clients are free to build and innovate, confident that their confidential and proprietary information, customer and employee relationships, and other protectable interests remain safe. In addition to drafting, reviewing, and modifying non-competition, non-solicitation, non-disclosure agreements and counseling clients on issues related to this area of law, I also litigate cases dealing with these issues in state and federal courts located ​throughout the​ country and before arbitration associations. These actions involve claims for breach of contract, breach of fiduciary duty and the duty of loyalty, tortious interference, misappropriation of trade secrets under state trade secret statutes and the federal Defend Trade Secrets Act, other unfair competition claims.
