About Jake Rubinstein

I am a trial lawyer and HR advisor in one of the nation's top law firms, providing Swiss-Army knife versatility in representing employers (and sometimes employees) in labor and employment litigation and counseling, and representing all types of enterprises in business litigation. I represent employers in discrimination cases, NLRB cases, arbitrations and wage/hour cases. I also negotiate collective bargaining agreements and conduct workplace investigations. I also represent executives joining or leaving companies, including non-compete litigation. I help clients solve problems without litigation when possible, and I win in court or arbitration if it comes to that. I have tried 26 jury trials in state and federal courts, approximately 100 bench trials and over 75 arbitrations across the United States. I have also represented clients in agencies including the NLRB, the EEOC, the Colorado Civil Rights Division, and other state agencies. Earlier in my career, I was a law clerk to Justice John J. Bowman of the Illinois Appellate Court. I also proudly served as a Cook County (Illinois) Assistant State’s Attorney for nine years, assigned to the Civil Bureau and later to the Criminal Bureau, prosecuting homicides and other violent crimes. My final assignment was as the Office’s specialist in serial sex crimes. My specific experience includes: Won a jury trial for a university and medical center in a lawsuit brought by a fired orthopedic surgeon who sought tens of millions of dollars.. Won a breach of contract case and obtained a judgment for costs against a retail employee who alleged her employer broke a binding promise to bend transfer rules for her benefit. Won a case for a university in an employment-related breach of contract case through an innovative combination of partial summary judgment and motion to dismiss. Won a jury trial in a Section 1983 and First Amendment employment case in which a civilian sheriff’s department employee alleged that he was fired for opposing the elected sheriff and for being affiliated with the opposing political party. Won a labor arbitration in which a police union challenged the termination of an officer for abusive treatment of a citizen and for lying about his actions during the internal affairs investigation. Won a labor arbitration in which a police union challenged the termination of an officer for filing a false police report. Won summary judgment for a university client in an age discrimination case in which the oldest staff member in an academic division was laid off in a reorganization.
