Dalton Green

Dalton counsels employers on all aspects of employment law, including hiring and termination practices, policy and handbook drafting, discrimination/EEOC claims, wrongful termination under the North Carolina Retaliatory Discrimination Act (REDA) and Title VII, wage and hour disputes (FLSA), and unemployment claims. She has a special interest in the impact of an employee’s use of technology, including social media and the internet, as well as employer-provided or employer-sanctioned smart phones and tablets, and she has presented on these topics at HRCI-accredited seminars. While she handles all aspects of employment law, Dalton's passion is handling workplace internal investigations. She loves nothing more than swooping in amidst complex and high-stakes allegations and helping her clients conduct prompt and thorough investigations. She interviews witnesses, gathers pertinent information and assesses the situation to determine whether policy violations, and/or discrimination may have occurred and provides clients with recommendations for remedial action. Dalton's open demeanor and her background in psychology make her particularly suited to this work, allowing her to quickly develop rapport with witnesses, helping them to feel comfortable discussing sensitive topics, while Dalton guides her clients through the complex legal issues raised by the information discovered. Dalton also has a special interest in the intersection of the Americans with Disabilities Act (ADA) and the Family Medical Leave Act (FMLA) with workers’ compensation laws, often referred to as “the Bermuda Triangle” of liability. Her experience in both employment practices liability and in the workers’ compensation arena makes her uniquely qualified to address these issues. She has presented at seminars advising employers on how to avoid and defend against potential litigation and routinely counsels clients on such matters.
