About David Tufts
David W. Tufts is a partner in the Salt Lake City office. He is the Chair of the Commercial Litigation practice group located in Salt Lake City, and a member of the Intellectual Property practice group. David is an experienced trial lawyer who has handled a broad array of business litigation matters, including state and federal trials as first chair in Utah and California, and appeals before the Tenth Circuit Court of Appeals, Utah Supreme Court and Utah Court of Appeals. This includes such areas as enforcement of merger and acquisition obligations, defense of consumer class action claims, disputes involving commercial fraud, securities fraud, and defamation, enforcement of trade secrets, trademarks, patents, copyrights and other intellectual property rights, unfair competition, noncompetition agreements, nondisclosure agreements, technology disputes, contract disputes, enforcement of security interests, real property matters, and claims for breaches of ERISA fiduciary duties. David is also known for his expertise in obtaining successful results defending cases involving the Utah One-Action Rule, the Utah Trust Deed Act, and similar laws that govern the relationships between lender, borrower and guarantor. In addition to trial work, David has significant experience in successfully obtaining pre-judgment relief and related remedies, including obtaining summary judgments for clients, writs of replevin, writs of attachment, writs of assistance, and temporary restraining orders and preliminary injunctions.
