Jonathan Kinney

My primary practice focuses on complex commercial litigation from both affirmative and defensive postures and internal investigations concerning potential civil, regulatory, and criminal liability exposure. I have represented companies and individuals in civil litigation in state and federal courts across the United States, in mediation and arbitration proceedings before major national and international alternative dispute resolution organizations, and internally in connection with investigations by state and federal regulatory and criminal agencies. I regularly advise clients with issues spanning several of these practice areas, including in private civil disputes that implicate potential regulatory or criminal liability (or vice versa), and help those clients to address and balance the overlapping and competing interests in such circumstances. I also take an active role in pro bono work. I have represented Afghan and Syrian asylum seekers in obtaining asylum and then permanent residency status, migrant children seeking Special Immigrant Juvenile Status, and other pro bono immigration work. I currently represent multiple Veterans seeking discharge upgrades from the Naval Discharge Review Board and other benefits from the U.S. Department of Veterans Affairs. I have represented a plaintiff class of thousands of foster children and their relative foster parents across the state of Ohio in the U.S. District Court for the Southern District of Ohio, seeking to enforce federal law requiring payment of foster care maintenance payments to those families. Prior to joining DLA Piper, I was an associate with a New York-based national law firm. There I handled an array of commercial litigation matters, ranging from single breach-of-contract claims to years-long antitrust recovery work for a Big Three auto manufacturer, among other high-stakes litigations. Prior to becoming an attorney, I served as an enlisted member of the United States Marine Corps, completing my enlistment as a Sergeant after serving for four years, including two tours in Iraq in support of Operation Iraqi Freedom in 2004-2006.
