About David Wolowitz

I serve as an expert witness on the standard of care for schools and other youth-serving organizations to safeguard children from misconduct by trusted adults. I have been retained by plaintiffs and defendants on matters in over a dozen states. In addition to being retained for current matters, I can testify on the evolution of the standard of care for child safeguarding over the past decades. I have been retained for multiple matters involving historical abuse claims dating back to the 1970s and 1980s. I am experienced in matters involving claims of child sexual abuse and harmful boundary violations by educators, coaches, mental health counselors, religious advisors, and other trusted adults. Issues in these matters often involve whether the employer was on notice and should have recognized red flags indicating misconduct so that the harm could have been prevented. I have been a practicing attorney for over 45 years. I have decades of experience advising school and other administrators daily on prevention and compliance measures to protect children in their care. My extensive experience as counsel to schools and youth-serving organizations includes developing policies, training staff, ensuring reporting compliance, conducting and supervising misconduct investigations, and overseeing remediation efforts. I can evaluate the adequacy of policies, training, and investigations, as well as employment practices, including hiring, supervision, and retention. I have followed social science research and other literature about the prevention of and response to child sexual abuse since the 1970s. I am able to testify on the evolution of the standard of care for child protection measures from the 1970s to the present. In addition to serving as a testifying expert, I oftern serve as a consulting expert. I have substantial civil and criminal trial experience in state and federal courts. I was an invited guest instructor for the Trial Advocacy Workshop at Harvard Law School for 29 years.
