About Joshua Franklin

I am a business trial attorney focused on commercial insurance recovery and business litigation. I have represented a wide range of businesses, including mutual funds, software companies, biotech companies, real estate developers, contractors, manufacturers, law firms, accounting firms, and medical practices as both plaintiffs and defendants in a variety of high-stakes disputes, including class actions. I have tried approximately fifty jury trials to verdict in Colorado and California. In the area of insurance coverage/bad faith, my firm only represents policyholders. We regularly handle matters arising out of an array of insurance policies, including directors and officers liability (“D&O”), errors and omissions (“E&O”), employment practices liability ("EPL"), commercial general liability (“CGL”), and cyber liability. I have litigated insurance coverage matters involving the duty to defend, the right to independent counsel, bad-faith claim handling, and a variety of other issues in state and federal courts in California and Colorado. I have also written and presented on the topic of cyber insurance coverage. In 2017, I served as the Chair of the San Diego County Bar Association’s Insurance/Bad Faith Law Section. I also frequently represent businesses in disputes alleging breach of contract and business torts, including fraud, breach of fiduciary duty, unfair competition, tortious interference with contract, and violations of various state and federal statutes, including California’s Unfair Competition Law (“UCL”), False Advertising Law (“FAL”), Consumer Legal Remedies Act (“CLRA”), and the Racketeer Influenced and Corrupt Organizations Act (“RICO”). Apart from my litigation practice, I completed mediation training at Pepperdine University’s Straus Institute for Dispute Resolution and occasionally serve as a mediator for commercial insurance coverage disputes. I am a current member of the Mediation Panel for the U.S. District Court for the Central District of California. My experience before forming Franklin Soto Leeds LLP includes litigating complex civil cases with Arnold & Porter LLP and serving as a Deputy District Attorney in the Economic Crime Unit of the Denver District Attorney’s Office. I have tried a wide variety of cases, ranging from insurance bad faith to securities fraud to first-degree murder, among others. I have a peer-review rating of “AV-Preeminent” from Martindale-Hubbell and have been recognized by Super Lawyers in the area of insurance coverage.
