About Joan Fife

I am head of the firm's SF employment group and Managing Partner of the SF office. I have been at Winston for 30 years, and have served on the Firm’s Executive Committee, Nominating Committee, Partner Compensation Committee, Diversity Committee, Hiring Committee, and Racial Equity Task Force. I represent employers throughout the country in class action employment litigation and have repeatedly been named one of the Daily Journal’s “Top Women Litigators in California” and “Top Labor and Employment Lawyers.” I was also named to the San Francisco Business Times' "Most Influential Women in the Bay Area" and The Recorder’s list of “Women Leaders in Law.” I have 35 years of experience as an employment litigator, and have had lead responsibility for more than 100 class or collective actions across the country and have never had a Rule 23 class certified against any of my clients. I have defeated conditional certification in nationwide FLSA actions a number of times. In one collective action, I secured over $800,000 of my client’s attorney’s fees. For 15 years, I have been the lead attorney defending one of the nation’s largest financial institutions in numerous wage and hour class and FLSA collective actions in California and across the country. My wage and hour class and collective actions have involved misclassification claims, independent contractor challenges, “off-the-clock claims,” meal and rest break claims, donning and doffing claims, rounding claims, “seating claims,” failure to reimburse claims, calculation of the regular rate claims, calculation of sick leave pay claims, inaccurate wage statement claims, minimum wage and overtime claims, and stand alone PAGA claims, among others. I have spent months as trial counsel defending hundreds of individual wage and hour damages claims, and served as trial counsel on the first trial on California’s seating law. I have defended hundreds of cases for employers facing claims of any type of discrimination, harassment, failure to accommodate, retaliation and wrongful termination. I also have extensive experience conducting investigations in heavily regulated industries, defending whistleblower claims, and representing companies in trade secret/noncompete litigation. I also counsel and assist employers with equal pay audits and wage gap audits. I attended mediation training at Harvard Law School, as well as with the United States District Court for the Northern District of California, where I serve as a court-appointed mediator.
